Federal Law "On State Registration of Real Estate" N 218-FZ

This law replaces the Law on state registration of rights to real estate and transactions with it.

In some cases, it was decided to register restrictions on rights and encumbrances on real estate, including easements, mortgages, trust management, leases, rentals.

A unified registration and registration procedure is envisaged. The Unified State Register of Real Estate (USRN) will be formed. The latter is conducted exclusively in electronic form. It will include a cadastre of real estate, a register of rights to it, a register of borders, registry files, cadastral maps, books for registering documents.

Will register the rights arising by virtue of the law, without the application of the copyright holder or the acquirer. The procedure is carried out on the basis of information received in the order of information interaction from authorities and notaries.

The limits of legal expertise for state registration of rights have been clarified.

The terms of cadastral registration and registration of rights have been reduced. A separate article is devoted to them. For example, 5 working days - from the date of receipt by the registration authority of the application for cadastral registration and the documents attached to it. 7 working days - from the date of receipt of the application for registration of rights.

Responsibility for actions (inaction) of bodies and persons participating in legal relations has been distributed.

The federal law comes into force on January 1, 2017, with the exception of certain provisions for which a different period is provided.
